Article 4: Online purchases

Place an order

If you agree with the terms and conditions, you can place your order definitively. You will receive a confirmation of your order by e-mail.

 

Pay

After you have placed your order, you will receive your invoice by email within 2 working days. Once your payment has been received, your order will be processed further.

 

Delivery

The order will be delivered to the delivery address specified by you within the specified delivery time. The delivery time starts when your payment is received.

Article 5: Delivery and implementation of the agreement

 

As soon as the products have been paid, the products will be sent via the postal parcel service provider. Shipments are made on fixed days, twice a week. The delivery time is 3 to 5 working days. Delivery costs are the responsibility of the customer, unless otherwise agreed with Cork Essentials. The shipping rates can be found on the website.
Items ordered through this web store are delivered in Belgium.

The delivery is done by Parcel (Bpost). The duration of the delivery depends on the delivery term of the chosen parcel service provider.

The costs depend on the shipping costs that the chosen supplier maintains.

All prices of the shipping costs can be consulted on the website.

These prices are subject to change that can be imposed by the supplier. The products are shipped on 2 fixed days a week, if the product is in stock, this period may be subject to changes imposed by the parcel service provider.
Unless otherwise agreed or expressly determined otherwise, the goods are delivered to the Client's place of residence within 30 days of receipt of the order. Any visible damage and / or qualitative shortcoming of an item or other shortcoming in the delivery must be reported by the Customer to Cork Essentials without delay.

The risk of loss or damage is transferred to the Customer as soon as he (or a third party designated by him, who is not the carrier) has physically taken possession of the goods. However, the risk will already pass to the Customer upon delivery to the carrier, if the Customer's carrier has been instructed to transport the goods and Cork Essentials has not chosen this option.
 

Article 6: Retention of title

The delivered items remain the exclusive property of Cork Essentials until full payment by the Customer.

The Customer undertakes to inform third parties of the retention of title of Cork Essentials, if necessary, for example to anyone who would seize articles that have not yet been paid in full.

 

Article 7: Right of withdrawal

 

The provisions of this article apply only to Customers who, in their capacity as consumers, purchase items online from Cork Essentials.

If the right of withdrawal applies:

The Customer has the right to withdraw from the contract within 14 calendar days without giving any reason.

The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, physically takes possession of the good.

 

To exercise the right of withdrawal, the Customer must notify Cork Essentials, Korte Kopstraat 69 2900 Schoten, +32 484 97 31 9, info@corkessentials.com via an unambiguous statement (e.g. in writing by post or email) of his decision to withdraw from the contract. The Customer can use the attached model withdrawal form for this, but is not obliged to do so.

The Customer must return or hand over the goods to Cork Essentials, Korte Kopstraat 69 2900 Schoten immediately, but in any event no later than 14 calendar days after the day on which he communicated his decision to withdraw from the contract to Cork Essentials. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.

 

The direct costs of returning the goods are for the account of the Customer, unless otherwise agreed and confirmed in writing by Cork Essentials.

 

If the returned product has been impaired in any way, Cork Essentials reserves the right to hold the Client liable and to claim damages for any depreciation of the goods resulting from the use of the goods by the Customer which goes beyond what is necessary to establish the nature, characteristics and functioning of the goods.

 

Only items that are in the original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be taken back.

 

If the Customer revokes the agreement, Cork Essentials will refund to the Customer all payments received from the Customer up to that time, including the standard delivery costs, within a maximum of 14 calendar days after Cork Essentials has been informed of the Customer's decision to to revoke the agreement. In sales contracts, Cork Essentials can wait with the refund until it has received all the goods back, or until the Customer has demonstrated that it has returned the goods, whichever comes first.

Any additional costs resulting from the Customer's choice of a method of delivery other than the cheapest standard delivery offered by Cork Essentials will not be refunded.

 

Cork Essentials will reimburse the Customer with the same payment method with which the Customer performed the original transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not be charged for such a refund.

 

 

Article 8: Warranty

 

Under the Act of 21 September 2004 on the protection of consumers when selling consumer goods, the consumer has legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial warranty is without prejudice to these rights.

If a defect is found, the Customer must inform Cork Essentials as soon as possible. In any case, any defect must be reported by the Customer within 2 months of its discovery. Afterwards, any right to repair or replacement lapses.

 

The (commercial and / or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, modifications or changes to the item, heavy use, poor maintenance, or any other abnormal or incorrect use.


Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable delivery, are deemed not to be hidden defects, unless the Client proves otherwise.

Article 10: Penalties for non-payment
